Special Court of Nepal

The Special Court of Nepal is a special judicial body established to hear cases related to corruption and abuse of authority, primarily those filed by the Commission for the Investigation of Abuse of Authority (CIAA). It operates under the framework of Nepal’s judicial system but functions independently to expedite and specialize in corruption-related cases.

Establishment and Legal Basis

The Special Court was established under the Special Court Act, 2059 (2002), as part of Nepal’s efforts to strengthen anti-corruption mechanisms. It has jurisdiction over cases referred by the CIAA and other corruption-related institutions.

Composition

The court typically consists of three judges:

  • One judge is from the Appellate Court level.

  • Two are gazetted special class judges appointed by the Judicial Council of Nepal.

These judges are appointed for a fixed term and are selected based on their legal expertise and experience in handling sensitive and high-profile cases.

Jurisdiction and Function

The court primarily handles:

  • Corruption cases filed by the CIAA.

  • Cases involving money laundering, misuse of public property, and other crimes against public administration.

  • It has both original and appellate jurisdiction in specific types of cases.

Significance

  • It plays a key role in ensuring transparency, good governance, and accountability in Nepal.

  • The court helps reduce the burden on regular courts by focusing solely on corruption-related cases.

  • It also acts as a deterrent to public officials and institutions from engaging in corrupt practices.

Appeals

Decisions made by the Special Court can be appealed to the Supreme Court of Nepal, ensuring checks and balances within the judiciary.
